Terms of Service
1. About these terms
These Terms of Service ("Terms") form a contract between Brian McCallum Draughting Ltd (the "Company", "we", "us") and the person or organisation using the DraughtAI service (the "Customer", "you"). By creating an account, starting a trial, paying for a subscription or using the service in any other way, you agree to these Terms. If you do not agree, you must not use the service.
2. The service
DraughtAI is a web-based software service that produces draft technical drawings (DWG, DXF, PDF) from inputs you provide, using a combination of computer-vision pipelines and third-party large language models. The service is intended for use by qualified draughtspeople, engineers, architects and contractors as a productivity tool, not as a substitute for professional review and sign-off.
2.1 Output is a draft
Drawings produced by DraughtAI are drafts. They must be reviewed and signed off by a competent person who is qualified under UK practice (or the equivalent in your jurisdiction) before they are issued for tender, planning, building control or construction. The Company is not the designer of record for any project.
2.2 No professional advice
The service does not constitute architectural, engineering, surveying or structural advice. Outputs are tools to support your professional judgment.
3. Eligibility & account
You must be at least 18 years old and capable of forming a binding contract. You must provide accurate registration information and keep your password confidential. You are responsible for activity that occurs under your account.
4. Acceptable use
You must comply with our Acceptable Use Policy, which is incorporated into these Terms. In particular, you must not use the service to:
- generate human likenesses, deepfakes or political imagery;
- infringe any third party's intellectual property or contractual rights;
- produce content that is unlawful, defamatory, harassing or otherwise harmful;
- circumvent rate limits, security controls or authentication;
- resell or redistribute outputs as a stand-alone service.
5. Subscriptions, fees & renewals
Plans, prices and limits are described on the pricing page. Prices are quoted in GBP and exclusive of VAT. UK customers are charged 20% UK VAT; EU OSS handling is automatic.
Paid subscriptions auto-renew on the same day each calendar month (or each year, for annual plans) at the then-current price. We send a reminder 7 days before each monthly renewal and 30 days before each annual renewal. You can cancel at any time from the customer portal or by emailing billing@mccallumdraughting.com; the cancellation takes effect at the end of the current paid period.
All payments are processed by Stripe Payments UK Ltd. We do not store your full card details. UK Strong Customer Authentication is enforced.
6. Your content & warranties
You retain all rights to the files and prompts you upload ("Customer Content"). By uploading, you grant the Company a worldwide, non-exclusive, royalty-free licence to host, process and display Customer Content for the sole purpose of providing the service to you. This licence ends when the Customer Content is deleted from our systems.
You warrant that you own or have all necessary rights to upload the Customer Content; that processing it through DraughtAI does not infringe any third-party intellectual property, contractual or moral rights; and that the Customer Content does not contain material we are required to refuse under our Acceptable Use Policy.
We do not use Customer Content to train, fine-tune, evaluate or improve any AI model — ours or a subprocessor's.
7. Output & ownership
Subject to your compliance with these Terms and full payment of fees, you own the drawings DraughtAI produces from your inputs ("Output") to the extent legally possible under UK law. You are solely responsible for verifying that any Output is suitable for its intended purpose and for any onward use of the Output.
You acknowledge that AI systems can produce similar outputs for similar inputs and that no exclusivity over Output is guaranteed where two customers happen to provide similar inputs.
8. Refunds
Our refund policy is set out in the Refund Policy. In summary: we offer a 7-day money-back guarantee on first-time subscriptions, and pro-rata refunds on unused full months thereafter on cancellation.
9. Service availability & SLA
We aim for 99.5% monthly uptime on Solo and Studio plans, and 99.9% on Enterprise. We carry out planned maintenance during UK off-peak hours where possible and announce it at least 48 hours in advance. We are not liable for downtime caused by third-party providers, force majeure or your local network.
10. Privacy & data protection
The Company is the data controller for personal data collected through the service. Our Privacy Policy describes what we collect, why and how to exercise your rights under UK GDPR and the UK Data Protection Act 2018.
11. Confidentiality
Each party will keep confidential information received from the other party in confidence and use it only to perform under these Terms.
12. Intellectual property
The DraughtAI service, software, templates, documentation, brand and underlying technology are owned by the Company. Nothing in these Terms transfers any of those rights to you.
13. Disclaimers
Except as expressly set out in these Terms and to the maximum extent permitted by law, the service is provided "as is". We do not warrant that the service will be uninterrupted, error-free, or that Output will be free from inaccuracies. You must independently review and verify every drawing before relying on it.
14. Limitation of liability
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under UK law.
Subject to that, our total aggregate liability arising out of or in connection with these Terms in any 12-month period will not exceed the fees you paid to us in that period. We are not liable for indirect or consequential loss, loss of profit, loss of data or loss of business opportunity.
15. Indemnity
You will indemnify the Company against claims by third parties arising from (a) your breach of these Terms; (b) your use of Output; (c) infringement of third-party rights by Customer Content you submit; or (d) your professional use of any Output.
16. Suspension & termination
We may suspend or terminate your account for material breach of these Terms (including breach of the Acceptable Use Policy), non-payment, or where required by law. You may terminate at any time by cancelling your subscription.
17. Changes to the service or these Terms
We may update these Terms from time to time. We will give at least 30 days' notice of material changes by email and on this page. Continued use of the service after the effective date constitutes acceptance.
18. Governing law & jurisdiction
These Terms are governed by the laws of Scotland. The courts of Scotland have exclusive jurisdiction, save that we may seek injunctive relief in any competent jurisdiction.
19. Consumer rights (where applicable)
If you are a UK or EU consumer, nothing in these Terms affects your statutory rights, including the right to a 14-day cooling-off period under the Consumer Contracts Regulations 2013. By starting your subscription you acknowledge that the digital service begins immediately upon trial start, and you waive your cooling-off right with respect to digital content already supplied — but you remain entitled to the refund terms in our Refund Policy.
